Terms of Service
In short: the app is for practising, exploring and learning Bagh-Chal, and everything you play in it is free. Our paid tournaments are in-person events at a venue: the entry fee pays for your place at that event and is paid in person at the venue or online through eSewa, Khalti or ConnectIPS. The app has no wallet, never holds your money, allows no betting and pays nothing out. Play fair and keep your account to yourself.
These terms are an agreement between you and Bharpardo Event Pvt. Ltd., a company registered in Nepal (“we”, “us”), the operator of Baghchal World (the “Service”) — our Android and iOS apps and our website. By creating an account or using the Service you accept these terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use the Service
- You must be at least 13 years old to create an account.
- To pay the entry fee for an in-person tournament you must be 18 or older, or have permission from a parent or guardian who makes or approves the payment.
- You may not use the Service if we have previously banned you, or where the law does not allow it.
2. Your account
- Give accurate details and keep your email address or phone number up to date; we use it to verify you and to reset your password.
- One account per person. Do not share, sell or transfer your account, and do not play on someone else’s.
- Keep your password secret. You are responsible for what happens on your account. Tell us at once at [email protected] if you think someone else has used it.
- Your name and username are shown to other players. They must not be offensive, misleading or impersonate anyone, including our staff. We may change or remove a name that breaks this rule.
- You can delete your account at any time from Settings → Account → Delete account (see how to delete your account). What happens to your data is explained in our Privacy Policy.
3. The app is free, for practice and learning
The app is for practising, exploring and learning Bagh-Chal. You can play against the computer, pass and play with a friend on one device, play online in friendly rooms and quick matches, follow the tutorial, and watch games and replays. All of this is free: nothing you play in the app costs money or can win money, and paid tournament games are not played in the app. We may add, change or remove features, rulesets and game modes, and some features may be marked as beta.
Online games in the app are run and validated by our servers, and the server’s record of moves, timers and results is final. If you do not move in time the server may move for you, and missing too many turns or staying disconnected too long can forfeit the game.
4. In-person tournaments
- Our paid tournaments are in-person events, held at the venue, date and time announced in each tournament’s details. You play your tournament games there, at the venue, not in the app.
- Each tournament’s details — venue, schedule, entry fee, format, ruleset and any prize — form part of these terms for that tournament. Rules and instructions given by our staff at the venue also apply.
- You can use the app to find tournaments, register, check in, and follow brackets, standings and results.
- Arrive and check in as instructed. Staff may ask you to show identification. If you are not there when your game is called, you may forfeit it.
- Follow the venue’s rules and our staff’s instructions. We may remove anyone who behaves unsafely, disruptively or abusively. You are responsible for your own travel, accommodation and belongings.
- We may reschedule, move, pause or cancel a tournament, round or game for safety, rule breaches or reasons outside our control, and will tell registered players as early as we can.
- Our tournament staff decide disputes at the venue. If you think a result was recorded wrongly, tell staff at the venue or email us within 7 days with the details; we will review it and tell you our decision.
5. Entry fees, payments and refunds
- The entry fee for an in-person tournament is shown in Nepali rupees in the tournament’s details. It pays only for your place at that event. It is not a charge for using or playing in the app.
- You can pay the entry fee in person at the venue, where the tournament’s details allow it, or online through eSewa, Khalti or ConnectIPS. The payment provider’s own terms apply to an online payment. Keep your receipt.
- Your place is confirmed once we have received and verified your payment. Coupons are per tournament, can be used once per player, and may expire or run out.
- An entry fee is not a deposit or a wager, and it cannot be moved to another tournament or player.
- Any prize is described in the tournament’s details and is awarded by us in person at the event, never through the app. Winners may need to verify their identity, and prizes are subject to applicable tax law. We may withhold a prize won in breach of these terms.
Refunds. Entry fees are not refundable, except:
- if we cancel a tournament, we refund the entry fees of confirmed players;
- if you were charged twice for the same entry, we refund the extra payment;
- if your payment went through but the tournament was already full or closed, so your place could not be confirmed, we refund that payment.
Refunds are made by the same method you paid where possible — to the eSewa, Khalti or ConnectIPS account that paid, or in person for payments made at the venue — normally within 14 days of our confirming them; a payment provider may take longer to show them. No refund is due if you do not attend, arrive late, lose, are eliminated, delete your account or are disqualified. If you think you are owed a refund, email [email protected] with your payment details.
6. No wallet, no betting, no money held
Baghchal World is a game of skill. The app is not a wallet, banking, payment, gambling or betting service. In particular:
- There is no wallet, account balance, credits, coins or any other in-app currency. You cannot add, deposit or store money in the app, and we never hold money on your behalf.
- Every game in the app — against the computer, in friendly rooms or in quick matches — is free and never played for money.
- The only payment we take is the entry fee for an in-person tournament, paid at the venue or online through eSewa, Khalti or ConnectIPS.
- There are no withdrawals, cash-outs, winnings or payouts in the app, and we never send money to players through the app. The only money we ever return is an entry-fee refund under these terms.
- Players cannot bet, wager, stake or transfer money with each other.
- Points, results, rankings and statistics have no monetary value and cannot be exchanged for money.
- Any prize is described in the tournament’s details and awarded by us in person at the event (see section 5).
7. Fair play
You must not:
- use any engine, bot, software, device or other person to help choose your moves, whether in an online game or at a tournament;
- let anyone else play for you, or play for anyone else;
- create or use more than one account, especially to enter a tournament more than once;
- collude with an opponent, agree results, lose on purpose or otherwise fix a match;
- bet or wager on any game, or arrange such bets, inside or outside the app;
- exploit bugs, or disconnect deliberately to gain an advantage — report bugs to us instead;
- harass, threaten or abuse other players or staff.
If we reasonably believe you have broken these rules we may void your results, disqualify you, withhold any prize, suspend or close your account, and keep your entry fee. Where we can, we will tell you why.
8. Use of the Service
You must not copy, modify, reverse engineer or resell the apps; scrape the Service or access it by automated means except our published interfaces as intended; interfere with or overload our servers; try to access other accounts or data you are not allowed to see; or use the Service for anything unlawful.
9. Ownership
Bagh-Chal is a traditional game of Nepal and its rules belong to everyone. The Baghchal World name, logo, artwork, sound, apps, website and software are ours or our licensors’ and are protected by law. We give you a personal, non-transferable, revocable licence to use the apps for their intended purpose under these terms.
You let us display your name, username, avatar, games, results and statistics within the Service and in announcements of tournament results, for as long as needed to run and report on the league.
10. Other services
The Service relies on others, including Google sign-in, eSewa, Khalti, ConnectIPS and the app stores. Their terms apply to your use of them, and we are not responsible for their services.
11. Availability and your connection
We work to keep the Service running, but we do not promise it will always be available, uninterrupted or free of errors. You need a compatible device and a working internet connection for online play, and you are responsible for them and for any data charges.
12. Disclaimer and limits of liability
The Service is provided “as is” and “as available”. To the extent the law allows, we make no promises beyond those stated in these terms, and we are not liable for indirect or consequential losses, lost profits, or losses caused by events outside our reasonable control. Our total liability to you for any claim about the Service is limited to the entry fees you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under law that cannot be limited.
You are responsible for losses we suffer because you broke these terms or the law.
13. Suspension and termination
You can stop using the Service and delete your account at any time. We may suspend or close your account if you break these terms, if the law requires it, or if we stop offering the Service. If we stop offering the Service entirely we will refund entry fees for tournaments that had not started.
14. Changes to these terms
We may update these terms. We will change the date at the top and, for significant changes, tell you in the app or by email before they take effect. Changes do not apply to a tournament you have already entered unless needed for legal or fair-play reasons. If you keep using the Service after a change takes effect, the new terms apply.
15. Law and disputes
These terms are governed by the laws of Nepal. Please contact us first so we can try to resolve any problem. If we cannot, disputes will be decided by the competent courts of Kathmandu, Nepal.
16. Apple App Store
If you downloaded the app from Apple’s App Store: these terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app. If the app fails to meet any applicable warranty, you may notify Apple and Apple will refund the app’s purchase price (if any); to the extent the law allows, Apple has no other warranty obligation. Apple is not responsible for any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims; we are responsible for those as these terms provide. You confirm that you are not in a country subject to a U.S. Government embargo or listed on a U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
